Terms of Service

These terms are a contract between you and Commercer LLC, 33 N Gould St, Sheridan, WY 82801, USA, which operates Oddyssey. By creating an account or using the service you accept them. If you accept on behalf of a company, you confirm you can bind it.

The Acceptable Use Policy, AI Usage Policy, Communications Policy, Payments and Checkout Policy, Advertising Integrations Policy, Tracking Policy, Refund Policy and Privacy Policy are part of this agreement.

• You must be 18 or older and give accurate account details.
• You are responsible for everything done under your account, including by your team members and by agents acting on instructions given from your account.
• Keep your credentials safe and tell us promptly if you suspect unauthorized access.

• Paid plans are subscriptions billed in advance, monthly or annually, through Stripe. We do not store your full card details.
• Your subscription renews automatically for the same term until you cancel. You authorize recurring charges to your payment method until then.
• Usage-based charges, where a plan includes them, are billed in arrears for the period in which they were incurred.
• Upgrades take effect immediately and are prorated. Downgrades take effect at the start of the next billing period.
• Taxes are added where required by law. Prices are exclusive of VAT, GST and sales tax unless stated otherwise.
• Failed payments: we retry, and we may suspend the workspace after repeated failures. We will email you before suspending.
• We may change prices with at least 30 days' notice before the change applies to your next renewal.

You can cancel any time from your account settings. Cancellation stops the next renewal and your plan stays active until the end of the paid period. Refunds are handled under the Refund Policy.

Free plans and trials are provided as they are, with no guarantee of availability, and we may change or end them. Features labelled beta or coming soon may change or be withdrawn, and should not be relied on for critical work.

Oddyssey includes agents that draft, plan and, where you authorize it, execute actions such as creating campaigns, publishing pages and sending messages. Agents act on the permissions, budget ceilings and approvals you configure. You are responsible for those settings and for what is published or spent under them. We do not grant agents unrestricted spending authority and neither should you. Full detail is in the AI Usage Policy.

You keep all rights in the content, data, brand material and outputs you create or upload. You grant us a limited licence to host, process and transmit it solely to provide the service. We keep all rights in Oddyssey itself, including the software, design and documentation.

When you connect a store, ad platform, messaging provider or payment gateway, that provider's own terms continue to apply to you. We pass your instructions to them; we do not control their availability, pricing, review decisions or account enforcement.

We may suspend or terminate access without refund if you breach these terms or the Acceptable Use Policy, if your use puts the service or other customers at risk, or if we are required to by law or by a provider we depend on. Where it is safe and lawful, we will tell you first.

We work to keep Oddyssey available but we do not promise uninterrupted service on any plan without a separate written service level agreement. We may run maintenance, and we will give notice for planned downtime where we can.

The service is provided as it is. We do not warrant any particular marketing result, conversion rate, return on ad spend or margin outcome. Agent output can be wrong; you are responsible for reviewing it before you publish or spend.

To the maximum extent the law allows, neither party is liable for indirect, incidental or consequential loss, or for lost profits, lost revenue or lost data. Our total liability for any claim is capped at the fees you paid us in the 12 months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.

You will defend and hold us harmless from claims arising out of your content, your campaigns, your messages, your products, your use of connected platforms, and your breach of this agreement or of applicable law.

Either party may end this agreement at any time. On termination your access stops and your data is deleted under the retention terms in the Privacy Policy. Export your data before you close the account; we will honour an export request made within 30 days of closure.

This agreement is governed by the laws of the State of Wyoming, USA, without regard to conflict of law rules, and the courts of Wyoming have exclusive jurisdiction. Consumer rights that apply where you live are unaffected.

We may update these terms. Material changes are emailed to account owners at least 30 days before they take effect; continuing to use the service after that means you accept them. Questions go to support@tryoddyssey.com.
